Final Rules, Guidance, and Assistance

FDA Final Rules and Guidance for the Produce Industry Regarding FSMA posted Sept. 2016

FDA FSMA Technical Assistance Network (TAN)
Technical assistance for industry, regulators, academia, consumers and others regarding the implementation of FSMA.

Operational since September 2015, TAN addresses questions related to the FSMA rules, FSMA programs, and implementation strategies after the rules are final.

Compliance Dates and Food Facility Registration

New Consolidated Compliance Date Web Page
October 2017: FDA introduced a new web page consolidating the compliance dates for the agency's FSMA rules.

Rules with compliance dates, in the order they became final:
- Preventive Controls for Human Food
- Preventive Controls for Animal Food
- Produce Safety
- Foreign Supplier Verification
- Sanitary Transportation
- Intentional Adulteration

These rules have staggered compliance dates, in part, based upon the size of a business. FDA has also provided a graphic timeline that shows thee staggered compliance dates by month and year.

Spring 2017: Several associations collaborated to produce the following document for suppliers and buyers to reference as affirmations of compliance are requested (e.g., FSVP or PSR compliance, facility registration, etc.). Refer to the PDF below for compliance information.

Recordkeeping Requirements

The Produce Safety Alliance has put together a summary of recordkeeping requirements und the Produce Safety Rule, than includes templates/worksheets.

Foreign Supplier Verification Programs

FSVP training courses are hosted by United Fresh and developed by the Food Safety Preventive Controls Alliance (FSPCA).

FSVP Clarification: if you are importing from a country with a food safety system recognized by the FDA (Canada, Australia or New Zealand): the modification only applies if the import won't be further processed, e.g., if you're importing a RAC that goes to fresh-cut, you need to do full FSVP, even if the RAC is imported from Canada.
